Terms of Service

These Terms of Service govern your access to and use of the First Capital Funding website and our consulting and commercial finance brokerage services. First Capital Funding is an independent commercial finance brokerage and business consulting firm; we arrange financing through independent third-party funding providers and do not issue loans ourselves. By using this site, submitting an application, or authorizing a payment, you agree to these terms on behalf of yourself and the business you represent.

01Website Use

The content on this site is provided for general informational purposes for business owners and is not legal, tax, accounting, or investment advice. You agree not to misuse the site, attempt unauthorized access, scrape or harvest data, submit false information, upload malicious files, or use any intake form for a purpose other than a genuine business inquiry.

02Our Services

We provide commercial finance brokerage and business consulting services, including merchant cash advance consulting, business term loans, business lines of credit, equipment financing, invoice factoring, SBA loans, revenue-based financing, business credit consulting, personal funding consulting, 0% business credit card consulting, financial consulting, and general business advisory services.

Our role is to review your objectives, structure and package your request, present it to independent funding providers, and advise you through the process. Engagements for consulting work may be governed by a separate written agreement, which controls in the event of a conflict with these terms.

03We Are Not a Lender

First Capital Funding is not a bank, lender, or funding source. We do not make credit decisions, issue loans, or advance funds. All financing is originated and funded by independent third-party providers that make their own underwriting decisions under their own agreements, rates, fees, and terms.

04No Guarantee of Approval or Outcome

Nothing on this site, in any calculator output, program page, statistic, or conversation with a representative is a commitment to lend or a promise of approval, amount, rate, term, or timing. Calculator results are illustrative estimates only. Results vary by applicant, provider, industry, credit profile, and market conditions.

05User Responsibilities

  • You represent that you are at least 18, are authorized to act for the business you submit, and are seeking funding for commercial — not personal, family, or household — purposes.
  • All information and documents you submit must be accurate, current, and yours to provide.
  • You authorize us to share your submission with independent funding providers and partners for the purpose of pursuing your request.
  • You are responsible for independently reviewing any offer, agreement, or disclosure a funding provider presents to you before signing.

06Third-Party Providers and Links

The site may link to or reference independent providers, partners, and platforms. Those relationships may be compensated through commissions or referral fees paid by the provider. We do not control and are not responsible for the products, terms, content, conduct, or privacy practices of any third party.

07Fees and Compensation

Where we are compensated by a funding provider, that compensation is paid by the provider. Where consulting, advisory, or processing fees are charged directly to you, those fees will be disclosed in writing in an invoice, payment request, or engagement agreement before payment is collected.

08Payment Authorization

By submitting a payment through our payment portal you represent that you are an authorized signer on the account used, that the payment corresponds to an invoice, agreement, or payment request issued by an authorized representative, and that you authorize the charge or ACH debit in the amount and on the date shown. Payment terms are detailed in our Payment Terms and Refund Policy.

09Electronic Signatures and Records

Under the federal E-SIGN Act and applicable state law, you consent to transact electronically. Signatures typed, drawn, or otherwise submitted through our forms, and records delivered by email or through the site, have the same legal force as handwritten signatures and paper records. You may request a paper copy of any executed authorization at team@firstcapfunding.com.

10Intellectual Property

The First Capital Funding name, logo, site design, copy, program materials, and calculators are owned by First Capital Funding and protected by intellectual property law. You may not copy, republish, or create derivative works from them without prior written permission.

11Disclaimers and Limitation of Liability

The site and our services are provided "as is" without warranties of any kind, express or implied, to the fullest extent permitted by law. To the maximum extent permitted by law, First Capital Funding and its members, officers, and personnel will not be liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits or lost funding opportunities. Our aggregate liability arising out of the site or our services will not exceed the total fees you paid us in the twelve months preceding the claim.

12Indemnification

You agree to indemnify and hold harmless First Capital Funding and its personnel from claims, losses, and expenses arising out of information you submit, your breach of these terms, or your dealings with any third-party funding provider.

13Dispute Resolution

The parties will first attempt to resolve any dispute informally by contacting team@firstcapfunding.com. If unresolved within 30 days, the dispute will be settled by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, seated in New Jersey, before a single arbitrator. Each party waives any right to a jury trial and to participate in a class or representative action. Either party may bring an individual claim in small-claims court.

14Governing Law

These terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws rules. Subject to the arbitration provision above, the state and federal courts located in New Jersey have exclusive jurisdiction.

15Changes and Contact
