Privacy Policy

First Capital Funding ("First Capital Funding," "we," "us"), is a commercial finance brokerage and business consulting firm. This policy explains what information we collect from website visitors, funding applicants, partners, and paying clients; how that information is used and shared with independent third-party funding providers; and the choices available to you.

01Who This Policy Covers

This policy applies to firstcapfunding.com and every intake form, application, document upload, calculator, chat, and payment page operated under the First Capital Funding brand. Our services are directed to business owners and commercial entities in the United States. We do not knowingly collect information from anyone under 18.

Once your information is transmitted to an independent funding provider, lender, servicer, or credit partner at your direction, that party's own privacy policy governs its use of your information. We are not responsible for the privacy practices of those independent parties.

02Information We Collect

  • Identity and contact data: business legal name, DBA, owner name, title, email address, phone number, and mailing or property address.
  • Business and financial data: time in business, industry, monthly gross revenue, requested amount, use of funds, existing business debt, equipment quotes, invoices, and self-reported credit score range.
  • Uploaded documents: business bank statements, tax returns, articles of incorporation, EIN letters, driver's licenses, mortgage statements, purchase contracts, appraisals, voided checks, and similar underwriting materials you choose to submit.
  • Payment data: invoice number, payment amount, billing address, ACH bank routing and account information, payment method selected, wallet handle, and electronic signature.
  • Technical data: IP address, browser type, device type, referring page, user agent, and pages viewed.

03Cookies and Analytics

We use strictly necessary cookies to operate the site and keep sessions and form state working, and we may use analytics tooling to understand aggregate traffic patterns, measure page performance, and improve our programs pages. Analytics data is used in aggregate and is not used to make funding decisions.

You can block or delete cookies in your browser settings. Blocking strictly necessary cookies may prevent applications and the payment portal from functioning correctly.

04Funding Applications and Document Uploads

Information and documents submitted through a funding application are used to assess fit, structure a request, and present your file to independent third-party funding providers that may be able to serve you. Submitting an application is a request for brokerage and consulting assistance — it is not an application for credit with First Capital Funding, and it is never a guarantee of approval.

Uploaded documents are transmitted over encrypted connections and stored in a private, non-public storage bucket. Internal access links are time-limited and are issued only to authorized First Capital Funding personnel.

05Credit Inquiries

Preliminary review generally relies on information you provide and, where applicable, a soft inquiry that does not affect your consumer credit score. A hard inquiry is performed only by a funding provider, and only after you authorize it in connection with a specific offer.

06Email and SMS Communications

By providing your email address and phone number you consent to receive transaction-related and servicing communications about your inquiry, application, documents, invoices, and payments. Message and data rates may apply. You may reply STOP to opt out of text messages and use the unsubscribe link, or email team@firstcapfunding.com, to opt out of marketing email. Opting out of marketing does not stop essential communications about an active application or payment.

07Payment Information

Card payments are processed by our payment processor. Full card numbers are entered on the processor's secure, PCI-DSS compliant surfaces and are not stored on our systems. For ACH authorizations, we collect the bank information and signed authorization necessary to originate the debit you approve, and we retain the executed authorization as required by NACHA rules.

08How We Share Information

  • Independent third-party funding providers, lenders, factors, equipment lessors, and credit partners you ask us to submit your file to.
  • Service providers that host our site, store documents, deliver email, process payments, and provide analytics — each bound to use the data only to perform services for us.
  • Professional advisors, auditors, and insurers, where reasonably necessary.
  • Government, regulatory, or law-enforcement bodies where required by law, subpoena, or to investigate suspected fraud.

We do not sell your personal information, and we do not rent or share it for cross-context behavioral advertising.

09Data Retention

Application files and supporting documents are retained for as long as needed to provide our services and for a minimum of seven years thereafter where required for tax, accounting, anti-fraud, or recordkeeping obligations. Executed ACH authorizations are retained for at least two years after the authorization is revoked or the final debit is originated. Records no longer required are securely deleted or destroyed.

10Your Rights and Choices

Depending on your state of residence, you may have the right to request access to, correction of, or deletion of personal information we hold about you, to request a portable copy, and to appeal a denial of a request. Send requests to team@firstcapfunding.com with the subject line "Privacy Request." We will verify your identity before acting and will respond within the period required by applicable law.

Certain records — including executed payment authorizations, transaction records, and submitted application files — must be retained notwithstanding a deletion request.

11Security

We use TLS/SSL encryption in transit, encrypted storage at rest, access controls limited to authorized personnel, private document buckets with expiring links, and least-privilege server-side handling of sensitive submissions. No method of transmission or storage is perfectly secure, and we cannot guarantee absolute security. Do not send sensitive financial information by unencrypted email or text.
