Refund Policy
First Capital Funding charges only for consulting, advisory, and processing work that is disclosed in writing before payment. This policy explains when fees are refundable, how to request a refund, and how we handle chargebacks and returned payments.

01Scope
This policy applies to fees paid directly to First Capital Funding. It does not apply to amounts charged by an independent funding provider, lender, factor, or servicer — including origination fees, discount fees, or interest — which are governed solely by your agreement with that provider.
02Consulting Fees
Consulting and advisory fees are earned as work is performed. If you cancel before any substantive work has begun, the fee is refundable in full. If work has begun, we refund the unearned portion, prorated against the hours and deliverables completed as of the cancellation date. Delivered deliverables — completed file packaging, credit strategy plans, structured proposals, submitted applications, and lender negotiations — are considered performed and are non-refundable.
03Brokerage Fees
Where a brokerage fee is payable by the client, it is earned when a funding offer is procured and accepted, or when funding is disbursed, whichever is stated in your engagement. If no offer is procured, any client-paid brokerage fee is refunded in full. Brokerage compensation paid to us by a funding provider is not a client charge and is not subject to refund.
04Processing and Administrative Fees
Processing, document-handling, and third-party pass-through fees (such as credit report, filing, appraisal, or verification costs) cover costs we incur on your behalf and are non-refundable once incurred, even if funding is ultimately declined.
05Declined Funding
A declination by a funding provider does not by itself entitle you to a refund of fees for work already performed. We do not charge success-contingent fees before an offer is procured, and we will always tell you in writing what a fee covers before it is collected.
06How to Request a Refund
- Email team@firstcapfunding.com with the subject line "Refund Request" within 30 days of the charge.
- Include the invoice number, payment date, amount, payment method, and the reason for the request.
- We acknowledge requests within 2 business days and issue a written determination within 10 business days.
- Approved refunds are returned to the original payment method within 5–10 business days of approval.
07Chargebacks
If you believe a charge is incorrect, contact us first — most issues are resolved within a business day. Filing a chargeback without first contacting us is a breach of these terms. We respond to all disputes with the executed authorization, invoice, engagement agreement, and delivery records. Where a chargeback is reversed in our favor, you remain responsible for the original amount plus any processor dispute fee.
08ACH Returns and Returned Payments
ACH debits returned for insufficient funds, a closed account, or a stop payment, and any returned check or declined card, may be re-presented once in accordance with NACHA rules and the authorization you signed. A returned-payment fee of $35, or the maximum permitted by applicable law if lower, may be assessed per returned item. Unpaid balances may be suspended from service until cured.
